תקנון תנאי שימוש

1. כללי / General Provisions
1.1 השימוש באתר מהווה הסכמה לתנאי שימוש אלו.
1.2 הרכישה מותרת רק לבגירים (18+) ותחת אחריות מלאה של המשתמש.
1.3 אישור תנאי השימוש מהווה הסכמה חוזית מחייבת בינך לבין החברה.

1.1 Use of the website constitutes agreement to these terms.
1.2 Purchases are permitted only for adults (18+) and under the full responsibility of the user.
1.3 Acceptance of these terms constitutes a binding contract between you and the Company.
2. זהות החברה / Company Identity
2.1 החברה פועלת כחברה זרה הרשומה בדובאי, איחוד האמירויות הערביות (UAE), ואינה מפעילה מוסד קבע, שלוחה, מחסן או כל פעילות פיזית במדינת ישראל.
2.2 שירות הלקוחות ניתן באמצעות דוא”ל וטלפון בינלאומי בלבד. אין מענה טלפוני מישראל.
English:
2.1 The Company operates as a foreign entity registered in Dubai, UAE, and does not maintain a permanent establishment, branch, warehouse, or any physical activity in Israel.
2.2 Customer support is provided via international email and phone only. No support is provided from within Israel.
3. תהליך הרכישה / Purchase Process
3.1 האתר מציג מחירים בהתאם למיקום הגיאוגרפי של המשתמש (שקל בישראל, דולר ללקוחות בינלאומיים). ההתאמה מתבצעת אוטומטית ואינה מעידה על פעילות בישראל.
3.2 כל הרכישות נעשות ישירות מול החברה בדובאי. לא מתבצעת מכירה מקומית בישראל.
3.3 המשך ביצוע הזמנה מותנה באישור תנאי השימוש באמצעות תיבת סימון (checkbox) — המאוחסן ומגובה עם פרטי IP, דפדפן, זמן וכו’.
3.4 המשתמש מצהיר כי המשלוח נועד לשימוש אישי בלבד ומהווה ייבוא אישי מרצונו החופשי. כל אחריות רגולטורית תחול עליו בלבד, לרבות מיסים, מכס, תקנים או מגבלות במדינתו.
English:
3.1 Website displays prices based on user location (ILS in Israel, USD internationally). This is a technical adaptation and not a commercial indication.
3.2 All purchases are made directly from the Company in Dubai. No local sales occur in Israel.
3.3 Purchase completion requires checkbox agreement to these terms — with data (IP, browser, timestamp) securely stored.
3.4 Buyer confirms the shipment is for personal use only and constitutes personal import. All regulatory obligations (tax, customs, etc.) remain with the buyer.
4. מוצרים ואחריות / Products & Disclaimer
4.1 כל המוצרים מוצגים באתר כפי שהם (AS IS) — אין התחייבות לתוצאה מסוימת.
4.2 אין לראות בתיאורי המוצרים ייעוץ רפואי. השימוש הינו באחריות הלקוחה בלבד.

4.1 Products are presented AS IS — with no guarantee for specific outcomes.
4.2 Product descriptions do not constitute medical advice. Use is under the sole responsibility of the customer.
5. ביטולים, החזרות ומשלוחים / Cancellations, Returns & Shipping
5.1 ניתן לבטל עסקה אם המשלוח לא הגיע תוך 30 ימים. ביטול יתבצע בכפוף לאימות סטטוס השילוח.
5.2 לא ניתן להחזיר מוצרים שנפתחו או נעשה בהם שימוש. החזר יינתן רק עבור מוצרים באריזתם המקורית הסגורה ובכפוף לאישור מראש.
5.3 לא מתבצעים החזרות לכתובת בישראל. על הלקוחה לתאם מראש את החזרה למחסן בינלאומי.
5.4 תקנות הגנת הצרכן הישראליות אינן חלות על רכישות אלו, שכן הן נעשות מול ישות זרה בייבוא אישי.
5.5 כל המשלוחים מתבצעים ממחסן לוגיסטי בסין (באמצעות YunExpress) ולא ממדינת ישראל.
English:
5.1 You may cancel the order if the shipment does not arrive within 30 days, subject to tracking verification.
5.2 Opened or used items cannot be returned. Returns only accepted if sealed and approved in advance.
5.3 Returns to Israel are not permitted. Buyer must coordinate international return.
5.4 Israeli consumer protection laws do not apply to these purchases, which are personal imports from a foreign entity.
5.5 All shipments originate from a logistics warehouse in China (via YunExpress), not from Israel.
6. פרטיות / Privacy
6.1 האתר פועל בהתאם לתקנות הגנת המידע של האיחוד האירופי (GDPR) ואינו מחזיק או מנהל מאגר מידע בישראל.
6.2 המידע נשמר בשרתי ספקים מאובטחים בחו”ל בלבד.
English:
6.1 Site complies with the EU’s GDPR and does not operate or maintain any data storage within Israel.
6.2 Information is stored securely on servers located outside of Israel.
7. אחריות מוגבלת / Limited Liability
7.1 החברה לא אחראית לנזק כלשהו — ישיר או עקיף — שייגרם מהשימוש במוצרים.
7.2 כל השימוש במוצרים נעשה על אחריות מלאה של הלקוחה בלבד.
English:
7.1 The Company shall not be held liable for any direct or indirect damages resulting from the use of its products.
7.2 Use of products is at the full and sole responsibility of the customer.
8. קניין רוחני / Intellectual Property
8.1 כל התכנים באתר לרבות טקסטים, עיצובים, תמונות, גרפיקה ולוגואים – הם רכוש בלעדי של החברה.
English:
8.1 All site content including texts, designs, images, graphics, and logos are the exclusive property of the Company.
9. סמכות שיפוט / Jurisdiction
9.1 כל סכסוך יתברר אך ורק בהתאם לדיני איחוד האמירויות ובסמכות בתי המשפט בדובאי בלבד.
9.2 הדין הישראלי לא יחול בשום מקרה או נסיבות.
English:
9.1 All disputes will be governed solely by the laws of the UAE and subject to the jurisdiction of the courts in Dubai.
9.2 Israeli law shall not apply under any circumstances.
10. תביעות ייצוגיות / Class Action Waiver
10.1 לא ניתן להגיש תובענה ייצוגית נגד החברה בכל מדינה, אלא אם החוק המקומי מחייב אחרת.
10.2 למען הסר ספק, סעיף זה לא יתפרש כהסכמה לפטור לפי דין מחייב במדינה בה לא ניתן להתנות על זכות לתובענה ייצוגית.
English:
10.1 Class action lawsuits against the Company are not permitted in any jurisdiction unless explicitly required by local law.
10.2 For the avoidance of doubt, this clause shall not be interpreted as a waiver where such waiver is prohibited by mandatory law.
11. שונות / Miscellaneous
11.1 כל המידע באתר ניתן כפי שהוא (AS IS), ללא התחייבות.
11.2 האתר מתעד הסכמות, תיעוד IP, דפדפן וזמן ביצוע ההזמנה.
11.3 כל השיווק מיועד לקהל גלובלי. אין שיווק ממוקד או פרסום לישראל.
11.4 החברה אינה מפעילה מחסן, מוקד שירות או כל פעילות אחרת בתחומי מדינת ישראל. השירות ניתן דיגיטלית בלבד.
11.5 לא ניתן לראות בפעילות החברה כל זיקה ממשית או זיקה תפעולית לישראל, לרבות לעניין חבות מס, תחולה צרכנית, או תחולה רגולטורית אחרת, שכן אין לחברה כל נציגות, שלוחה, ספק שירות או גוף מתווך הפועל בתחומי מדינת ישראל.
11.6 החברה רשאית לעדכן תקנון זה מעת לעת לפי שיקול דעתה.
11.7 הצגת מחירים בשקלים והשפה העברית באתר מבוצעת אוטומטית לפי מיקום המשתמש לצורכי נוחות בלבד, ואינה מהווה עדות לפעילות שיווקית או מסחרית בישראל.
11.8 השירותים הטכניים באתר (לרבות סליקה, דיוור ומסחר) מסופקים באמצעות מערכות צד ג’ גלובליות כמו Shopify, Klaviyo ו-Stripe, שאינן מופעלות על ידי החברה ואינן פועלות מישראל.

11.2 Website records user agreement, IP, browser and timestamp.
11.3 Marketing is intended for a global audience. No Israel-targeted promotion is conducted.
11.4 The Company does not operate any warehouse, service center, or business activity in Israel. Services are provided digitally only.
11.5 The Company’s operations cannot be considered as having any material or operational link to Israel, including for the purposes of tax liability, consumer applicability, or regulatory jurisdiction, as the Company has no representative, branch, service provider, or intermediary operating within the State of Israel.
11.6 Company may update these terms at its discretion.
11.7 Display of prices in ILS and Hebrew language is based on user location for convenience only and shall not be considered evidence of commercial or marketing activity in Israel.
11.8 The technical services of the site (including checkout, email and commerce) are provided via third-party global platforms such as Shopify, Klaviyo, and Stripe, which are not operated by the Company and do not operate from Israel.
